1. Acceptance of Terms

By downloading, installing, or using the Fittly mobile application (the "App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. About the App

Fittly is an AI-powered virtual try-on application developed and operated by Shelf Labs ("we", "our", or "us"). The App allows you to visualise clothing items on photos of yourself using artificial intelligence.

3. Eligibility

You must be at least 13 years old to use Fittly. By using the App, you confirm that you meet this requirement. If you are under 18, you confirm that you have obtained parental or guardian consent.

4. Account and Sign-In

You may sign in to Fittly using your Google account. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. We are not liable for any loss resulting from unauthorised use of your account.

5. Credits and Purchases

5.1 Free Tier

Fittly provides a limited number of free try-ons. Once your free credits are used, additional credits must be purchased.

5.2 In-App Purchases

Credit purchases are processed by the Google Play Store. All transactions are subject to the Google Play Terms of Service. We never receive or store your payment card details.

5.3 No Refunds

All purchases are final. We do not offer refunds for unused credits except where required by applicable law.

6. User Content

6.1 Your Photos

You retain ownership of any photos you upload to the App. By uploading a photo, you grant us a limited, non-exclusive licence to process that photo solely for the purpose of generating your try-on result.

6.2 Prohibited Content

You must not upload photos that contain nudity, are sexually explicit, depict minors, or violate any applicable law. We reserve the right to terminate accounts that violate this policy.

6.3 No Storage Beyond Necessity

We do not store your photos beyond what is necessary to deliver your try-on result. See our Privacy Policy for details.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract the source code of the App
  • Use automated tools to access or scrape the App
  • Impersonate any person or entity
  • Interfere with or disrupt the App's infrastructure

8. Intellectual Property

All content, features, and functionality of Fittly — including but not limited to the App's design, graphics, AI models, and software — are the exclusive property of Shelf Labs and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Third-Party Services

The App integrates third-party services for authentication (Google Sign-In), payment processing (Google Play), and AI image generation. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that try-on results will be accurate or meet your expectations.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Shelf Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Changes to These Terms

We may update these Terms of Use from time to time. We will notify you of significant changes by updating the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.
